AGREEMENT BETWEEN USER AND ABNY

APPLICABILITY

This User Agreement (“User Agreement”) forms the terms and conditions for the booking of services and products of ABNY Business Solutions Private Limited (“ABNY”).

Any person (“User”) who creates a profile by registering on the ABNY website or platform (“ABNY Platform”), for accessing and facilitating the processing of booking of any product(s) or service(s) on the ABNY Platform, agrees to be governed by this User Agreement.

Both User and ABNY are individually referred to as ‘Party’ and collectively referred to as ‘Parties’ to the User Agreement.

ELIGIBILITY TO USE

The User must be at least 18 years of age and must possess the legal authority to enter into an agreement to become a User. If the User is a minor (below the age of 18 years), they shall not register as a User or transact on the ABNY Platform.

If a minor wishes to use or transact on the ABNY Platform, such transactions may only be made by a legal guardian or parent. ABNY reserves the right to block or terminate access to the ABNY Platform if it is discovered that the User is a minor or legally incompetent.

Before using the ABNY Platform, Users must read and understand this User Agreement. By using the ABNY Platform, the User agrees to be bound by the terms laid out in this Agreement. If the User does not agree with any part of this Agreement, they must refrain from accessing or using the services.

All rights and liabilities of the User and ABNY concerning services or products facilitated by ABNY will be governed solely by this User Agreement.

CONTENT

All content provided on the ABNY Platform (“Content”) is protected by applicable intellectual property laws. Users cannot use this content for any other purpose, except as specified and authorized by ABNY.

Users agree to follow all instructions provided by ABNY regarding the use of the Content.

ABNY’s proprietary logos, trademarks, and service marks displayed on the ABNY Platform are not licensed to the User, and unauthorized use of these will be considered a violation of applicable law.

PLATFORM USAGE

The ABNY Platform is intended for lawful use by bona fide Users. Users are prohibited from distributing, exchanging, modifying, or transmitting anything from the ABNY Platform (including text, images, audio, and video) for business, commercial, or public purposes not directly related to their services on the ABNY Platform.

The User Agreement grants a limited, non-exclusive, non-transferable right to access the platform to facilitate the processing of product/service bookings. Users agree not to interrupt the operation of the ABNY Platform in any way.

Users represent and warrant that all information provided to ABNY during registration is true and accurate.

ABNY reserves the right to terminate access to the platform at any time, without notice, for maintenance or other reasons.

Users should report any unlawful, objectionable, or harmful content on the ABNY Platform to ABNY’s support at support@abny.com. Upon receiving such reports, ABNY reserves the right to investigate and take appropriate action.

LIMITED LIABILITY OF ABNY

ABNY acts as a facilitator by connecting the User with respective service providers such as airlines, hotels, bus operators, etc. (collectively, “Service Providers”). ABNY’s liability is limited to the facilitation services it provides.

Unless explicitly stated, ABNY does not assume responsibility for the quality, availability, or fitness of the services provided by Service Providers. ABNY does not guarantee the availability or quality of services listed by the Service Providers. The ultimate liability lies with the respective Service Providers.

USER’S RESPONSIBILITIES

Users are advised to verify the details of the services before confirming bookings. By booking a service, Users agree to abide by all terms and conditions related to the service and the User Agreement.

Users must comply with all applicable laws, regulations, and guidelines for using the ABNY Platform and ensuring legal and proper transactions.

The services are provided on an “as is” and “as available” basis, and ABNY makes no warranties regarding the services. ABNY disclaims all warranties of any kind, either express or implied, including implied warranties of merchantability.

SECURITY AND ACCOUNT INFORMATION

Users are responsible for maintaining the confidentiality of their login credentials and for all activities on their account. Any unauthorized use must be reported to ABNY immediately.

ABNY ensures data security but cannot guarantee a 100% secure system. For fraud detection, ABNY may verify certain information, and data may be shared with law enforcement for investigation purposes.

FEES AND PAYMENT

ABNY reserves the right to charge fees in addition to the product/service price, such as convenience or service fees. ABNY may change these fees from time to time, and Users will be notified accordingly.

Users must comply with all applicable taxes, duties, and assessments.

Booking(s) are subject to cancellation policies set by Service Providers or ABNY.

FORCE MAJEURE

ABNY and Service Providers may be unable to fulfill confirmed bookings due to factors like acts of God, government orders, technical failures, etc. In such cases, ABNY will not be liable for the inability to provide services, and the User must contact the Service Provider for resolution.

RIGHT TO REFUSAL BY ABNY

ABNY reserves the right to refuse any booking, service, or registration without assigning a reason. ABNY may suspend or terminate a User’s registration if they breach this Agreement or violate third-party rights.

CANCELLATION AND REFUSAL

ABNY reserves the right to cancel bookings or services if it finds any misrepresentation of information or breach of terms. Any cancellation initiated by ABNY will not make ABNY liable for any damages suffered by the User.

FAKE CALLS AND FRAUDULENT ACTIVITIES

ABNY will never ask for sensitive personal information like credit card numbers, passwords, or OTPs through phone calls or messages. If such requests are received, Users are advised to report them immediately.

INDEMNIFICATION

The User agrees to indemnify ABNY and its affiliates against any losses arising from breaches of the User’s representations, warranties, or non-performance of covenants.

COVID-19 TERMS

Due to the pandemic, end service providers may cancel or refuse bookings. ABNY will not be responsible for these cancellations. Refunds, if any, will depend on the service provider’s policies, and Users must ensure compliance with government guidelines.

MISCELLANEOUS

SEVERABILITY: If any part of this Agreement is deemed invalid or unenforceable, the remaining provisions will remain effective.

JURISDICTION: This Agreement is governed by Indian laws and disputes will be resolved in courts in Delhi.

AMENDMENT: ABNY may amend this Agreement at any time, and Users are responsible for reviewing the updated Agreement regularly.

PRIVACY POLICY: The User agrees to ABNY’s Privacy Policy, which governs the use of personal information.
